TRANSACTIONAL EXPERIENCE
Some of the ground breaking advisory work and transactions that our lawyers and the firm have completed include the following:
- Advised leading commercial banks and other financial institutions in relation to loan markets transactions (term loans, syndicated loans and other structured finance facilities) which are cumulatively worth over P 1 billion
- Acted as the lead advisor to Gamebite Investments (Proprietary) Limited in arranging a revolving working capital facility with a private lender
- Advised various international financial institutions in relation to the capacity and enforceability of financial markets transactions such as money markets, foreign exchange, derivatives (including forwards, futures, repos) and other securities lending & borrowing transactions concluded with Botswana based counterparties
- Acted as the lead advisor in the development of Anti-Money Laundering (AML) and Countering Terrorism Financing (CTF) policies for an investment advisory firm and a leading motor dealership in Gaborone
- Undertook detailed legal due diligence exercises on companies in the telecommunications, banking, property development and manufacturing sectors as part of capital raising, privatisation, mergers and share acquisition transactions
- Rendered legal advice in relation to the structuring and establishment of an en commandite (limited liability) private equity partnership with a leading pension fund in the country
- One of the partners acted as the sole litigator handling debt collection matters for one of the leading commercial banks in the country, resulting in the collection of over P 2,000,000 annually.
- Successfully prosecuted a claim on behalf of construction industry consultants (Civil engineers, quantity Surveyors and Architects) involved in a property development dispute worth over P 6,000.000.00
- Successfully defended a construction sector client in relation to a claim of over P3,000.000, 00 made by a leading trade finance credit provider with respect to on demand performance bonds and other guarantees.
- Acted for local and international clients in the registration and enforcement of various intellectual property rights in Botswana and regionally
